Terms & conditions

1. About us

Correspondence address: Verney Auctions, Dog Sports Derby, Broughton Heath Road, Church Broughton, Derby, DE65 5BE

The correspondence address is for enquiries and post. Please do not send or return items there without arranging this with us first.

These terms apply to use of our website and to buying and selling through Verney Auctions. Individual auction pages and lot listings may include additional information, including collection deadlines and any charges specific to that sale. Please read those details before bidding or entering an item.

2. Our auctions

We may hold timed online auctions, auctions with in-person bidding, or other sales described on the relevant auction page. We do not sell live animals.

We may act as an auctioneer on behalf of a seller or sell items owned by Verney Auctions. Where relevant, the lot listing or invoice will identify the seller and explain how VAT applies.

We may change an auction’s dates or times, amend a listing, withdraw a lot or refuse a bid where reasonably necessary, including where there is an error, a technical problem or a concern about the item or bidder.

3. Registering and bidding

You must provide accurate details when registering and keep your account information up to date. You are responsible for bids placed through your account and for keeping your login details secure.

Please inspect the description and photographs, ask any questions you have and attend a viewing if one is offered before bidding. Measurements, descriptions and photographs are provided to help identify an item, but you should check any detail that is important to you.

A bid is an offer to buy at the amount bid, subject to any applicable reserve and the auction rules. Please bid only if you intend to pay. We may set minimum bid increments, place a reserve on a lot or use automatic extensions near the end of a timed auction. The relevant auction page will show the bidding arrangements.

The highest bid does not result in a sale unless the reserve, if any, has been met and the bid is accepted. We may refuse or cancel bids where reasonably necessary to deal with an error, suspected misuse or a problem with the sale.

4. Prices, commission and VAT

Buyers: We currently charge no buyer’s premium. The amount you bid is the hammer price. Any VAT chargeable on the lot, delivery charge or other charge disclosed before you bid is additional.

Sellers: Our standard seller’s commission is 10% of the hammer price, unless we agree a different rate with you in writing before the lot is entered. Any additional seller charges must be agreed or clearly shown in the applicable seller information before they apply.

Verney Auctions currently are not VAT registered, so we do not currently add VAT to our own commission. Some lots may nevertheless be subject to VAT because of the seller’s VAT status or the arrangements for that sale. Where VAT applies to a lot, we will identify this in the listing or sale information before bidding.

5. Payment and collection

Successful bidders must pay by the deadline and using the methods stated in their invoice or the auction information. We will not release a lot until cleared payment has been received.

Collection details, location and deadlines will be stated in the auction information or provided to successful bidders. You are responsible for arranging suitable transport and enough help to load your purchase unless we have expressly agreed otherwise. Please contact us before travelling to collect.

If you cannot collect by the stated deadline, contact us promptly. We may charge reasonable storage or handling costs where these were disclosed before you bid or subsequently agreed with you.

6. Item descriptions and condition

Many auction items are used and may show wear, damage or missing parts. We will take reasonable care in preparing listings, and sellers must give us accurate information about their items.

An item’s condition and any stated faults should be considered before bidding. A description such as “untested” means that we have not verified that the item works; it does not remove any rights you may have under consumer law.

Nothing in these terms excludes a buyer’s legal rights where an item is misdescribed, faulty or otherwise does not meet the standards required by law. The rights available may depend on who is selling the item and whether the buyer is acting as a consumer or a business.

7. Consumer cancellation rights

If you are a consumer buying from a business through a timed online-only auction, you will generally have a legal right to cancel without giving a reason within 14 days after receiving the goods, subject to the legal exceptions. To exercise that right, tell us clearly by email or post within the cancellation period. You may use the form at the end of these terms, but you do not have to.

After notifying us, you must return the goods within 14 days. Unless we have agreed otherwise, you are responsible for the direct cost of returning them. We will refund payments due under the applicable law, normally using the original payment method. We may wait until we receive the goods back, or evidence that you have sent them, before making the refund.

Different rules can apply to an in-person public auction that consumers can attend, even when online bidding is also available. We will identify the auction format and any applicable cancellation information in the sale details. These terms do not take away any statutory rights you have if goods are faulty or misdescribed.

To contact us about a cancellation or another problem with a purchase, use the contact details in section 1 and include the auction name, lot number and your name.

8. Selling through Verney Auctions

By entering an item, you confirm that you are entitled to sell it, that it is not subject to an undisclosed finance agreement or other third-party claim, and that the information you give us is accurate. Tell us about any faults, damage, safety concerns, missing parts, VAT status or other information a buyer should reasonably know.

We may decline an item, request more information, amend its description after discussing it with you, or withdraw it from sale where reasonably necessary. We will agree any reserve with you before entering the item. We will also tell you in advance if a charge would apply should you withdraw an item after entry.

Seller commission is charged only on lots that sell. If an item does not sell, we will not charge seller commission. We will contact you after the auction to arrange collection by appointment, normally within seven days, or discuss entering it in another auction with your agreement.

For a sold item, we will provide a statement showing the sale price, agreed seller commission and amount due to you. We pay by bank transfer within five working days after the buyer’s payment has cleared and the transaction is final, including the end of any applicable cancellation period or dispute. We will let you know if settlement is delayed.

9. Vehicles, machinery and electrical items

Unless expressly stated otherwise, buyers should arrange any inspection they need before bidding. A current MOT, service record, safety certificate or test result will be mentioned only where we have evidence of it. Buyers must ensure that vehicles and equipment are transported, used and maintained safely and lawfully.

Sellers must disclose known faults, relevant paperwork and any finance or ownership restrictions.

10. Website availability and information

We aim to keep the website and bidding service available, but interruptions or technical errors can occur. If a problem may have affected an auction, we will take reasonable steps to investigate it and decide whether a lot should be reopened, extended, withdrawn or otherwise corrected.

Website content, photographs and branding must not be copied or used commercially without our permission, except where the law permits it.

Information about how we handle personal data is set out in our Privacy Policy.

11. Liability and your legal rights

Nothing in these terms limits or excludes liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or a consumer’s statutory rights.

Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was made. Business buyers and sellers are responsible for their own commercial decisions and any inspection or professional advice they require.

12. Changes and contact

We may update these terms from time to time. The version that applies to an auction transaction is the version provided or made available when you enter the item or place your bid, together with the relevant auction information.

If you have a question or complaint, please contact us using the details in section 1. We will try to resolve it promptly.

These terms are governed by the law of England and Wales, without affecting any mandatory rights that apply to consumers elsewhere.

13. Condition of Items — Sold as Seen

All items are sold as seen, in their existing condition, subject to the lot description and any disclosed faults. Bidders should review all descriptions and photographs and request any further information before bidding. Nothing in these terms excludes or limits any statutory rights that apply to the buyer.
